Apply nowThese Terms and Conditions (“Terms”) govern the Claude for Open Source Program (“Program”) offered by Anthropic, PBC (“Anthropic,” “we,” “our,” or “us”). By submitting an application to the Program, you (“Applicant” or “you”) agree to be bound by these Terms. If you do not agree, do not submit an application.
These Terms supplement and are in addition to Anthropic’s Terms of Service and Acceptable Use Policy, which continue to apply to your use of Claude Max.
1. Program Overview
The Program provides eligible open-source software maintainers and contributors with a complimentary subscription to Claude Max 20x for a period of six months (“Benefit Period”), at no cost to the Applicant. The Program is designed to recognize and support the individuals who build and maintain the open-source ecosystem.
The Program is limited to 10,000 approved recipients unless this cap is increased by Anthropic. Applications will be reviewed on a rolling basis until either the recipient cap is reached or the Program application period closes, whichever occurs first.
The following offer limits apply:
- Recipient Cap: The Program is intended to provide subscriptions to up to 10,000 approved recipients. Anthropic may choose to increase this cap.
- Program Duration: The application period remains open until Anthropic closes it. Anthropic may modify, suspend, or terminate the Program, or stop accepting applications, at any time and for any reason in its sole discretion, without prior notice. Applications pending at the time the Program closes may not be considered.
- One Per Person: Each eligible individual may hold only one active Program subscription at a time. Concurrent or duplicate applications, including applications submitted under a different email address or account, will be disregarded. Individuals may re-apply after the end of a Benefit Period as described in Section 4.3.
- Void Where Prohibited: This Program is void where prohibited or restricted by law.
2. Eligibility Criteria
To be considered for the Program, Applicants must, at the time they submit their application, meet at least one of the criteria in Section 2.1 or 2.2 and all of the general eligibility requirements in Section 2.3. These criteria are minimum thresholds for consideration. Meeting or exceeding these requirements does not entitle an applicant to a subscription; Anthropic evaluates each application in context and in its sole discretion, as described in Section 3.2.
2.1 Maintainer Track
You may qualify under the Maintainer Track if, at the time you submitted an application, one or more of the following describes you:
- Projects you maintain have, in aggregate, 500 or more dependent repositories or 100 or more dependent packages, as reported by the GitHub dependency graph or a public package registry (npm, PyPI, crates.io, RubyGems, Packagist, Maven, or similar);
- Packages you maintain have, in aggregate, 200,000 or more monthly downloads across any public package registry;
- You are a listed committer or maintainer of a recognized foundation or language project;
- You have authored 100 or more pull requests that were merged into public repositories you do not own within the 12 months preceding your application;
- A repository you maintain has had 20 or more unique external contributors with merged pull requests within the 12 months preceding your application; or
- A repository you maintain has an OpenSSF criticality score of 0.4 or higher.
In assessing whether you meet any of the criteria above, Anthropic evaluates the substance of the underlying activity. Contributions, reviews, or other activity that Anthropic determines to be trivial, duplicative, automated, or otherwise inconsistent with the spirit of the Program may be discounted or disregarded, even if a threshold is nominally satisfied.
2.2 Ecosystem Impact Track (Discretionary)
If you do not meet the criteria in Section 2.1, you may still apply if you maintain or significantly contribute to a project that the open-source ecosystem meaningfully depends on. Examples include widely-used infrastructure libraries, developer tooling, or foundational packages that serve as transitive dependencies for a large number of downstream projects.
Applicants under this track should provide a brief written explanation of the project’s ecosystem significance in their application. Anthropic will evaluate these applications based on factors including, but not limited to: the number of downstream dependents, the breadth of the project’s usage, the criticality of the project’s function, and the Applicant’s role in maintaining it.
2.3 General Eligibility Requirements
In addition to meeting one of the tracks above, all Applicants must:
- Be a natural person (not a corporation, partnership, or other entity);
- Be at least 18 years of age or the age of majority in their jurisdiction, whichever is greater;
- Be a legal resident of a country, region, or territory where Anthropic offers Claude.ai access and not be a person or entity subject to restrictions under U.S. export control or sanctions laws;
- Have an existing GitHub account in good standing that is at least two years old;
- Have public open-source contribution activity (commits, pull requests, reviews, or releases) within the 90 days preceding the submission of their application;
- Maintain or contribute to at least one project distributed under an OSI-approved open-source license (such as MIT, Apache 2.0, BSD, or GPL); and
- Not be an employee, contractor, or agent of Anthropic or its affiliates, or an immediate family member or household member of such person.
3 Application and Selection Process
3.1 How to Apply
To apply, submit the application form at claude.com/open-source-max with the following information:
- Sign in with your GitHub account;
- Your email address (used to deliver the subscription activation link if approved); and
- A brief description of how you plan to use your subscription; and
- A brief explanation (no more than 500 words) of why you qualify. Ecosystem Impact Track applicants should use this to describe their open-source work and its ecosystem significance.
We'll use your GitHub account to verify your eligibility, including your public open source contributions, and to retrieve the email address associated with your account (used to deliver the subscription activation link if approved).
Applications are reviewed on a rolling basis. Anthropic does not commit to any timeline for reviewing or responding to applications, and review times vary. Anthropic will contact you only if your application is approved and does not send notifications for applications that are not approved, so not receiving a response within any particular period does not mean a decision has been made on your application. Submitting the same application more than once will not speed up review and may cause your subsequent applications to be disregarded as duplicates.
3.2 Selection Discretion
Anthropic determines eligibility for this Program and approves or denies applications in its sole discretion. The criteria in Sections 2.1 and 2.2 describe who may be considered for the Program; they are not a promise of acceptance, and meeting or exceeding any threshold does not guarantee acceptance. In evaluating an application, Anthropic considers the full context of the Applicant’s open-source activity and may weigh factors including, but not limited to: the nature, substance, and quality of the Applicant’s contributions, and not solely their volume; the manner in which the activity underlying any numeric threshold was generated; whether the Applicant has previously violated Anthropic’s applicable Terms of Service, Usage Policy, or any other terms or policies; and the overall goals and capacity of the Program. Any application may be subject to additional human review before a decision is made.
All decisions are final and are not subject to appeal or review. Anthropic may, at its discretion, require an approved Applicant to verify their eligibility or sign additional documentation as a condition of receiving the subscription.
4. Subscription Details and Post-Benefit Period Terms
4.1 Activation
If approved, you will receive an email at the email address associated with your GitHub account containing a unique activation link. You must activate your subscription within 90 days after receiving the gift code; unactivated links will expire and the subscription will be forfeited. If you have an existing paid Anthropic subscription, your current billing will be paused for the duration of the Benefit Period and will resume at your then-current plan and rate at the end of the Benefit Period, unless you cancel before billing renews. If you have an existing free Anthropic account, the Program subscription will be applied to that account and your free subscription will resume at the end of the Benefit Period, unless you cancel.
4.2 Benefit Period
Your redeemed complimentary Claude Max 20x subscription will be active for six consecutive months beginning on the date you activate your subscription (“Benefit Period”). During the Benefit Period, you will not be charged for the base Claude Max 20x subscription, but you may be charged for overages in accordance with Anthropic’s standard overage pricing. You are solely responsible for determining any tax obligations arising from your receipt of the Program subscription. Anthropic makes no representations regarding the tax treatment of the subscription benefit and will not issue tax documentation unless required by applicable law.
4.3 What Happens After the Benefit Period
Your complimentary subscription lasts for the duration of the Benefit Period and, unless Anthropic in its sole discretion chooses to extend or renew it for additional period(s), does not renew automatically. While we intend to notify individuals who have redeemed complimentary subscriptions by email before the end of the associated Benefit Period, expiration is not conditioned on receipt of such notice. Any discretionary extension or renewal of a complimentary subscription as part of the Program is not an entitlement and does not obligate Anthropic to future extensions or renewals.
If the Program is still accepting applications, individuals who previously redeemed a complimentary subscription may re-apply, subject to Section 9 and any then-existing terms regarding the Program. New applications are evaluated under the then-current eligibility criteria and Program terms, and acceptance during one Benefit Period does not entitle you to acceptance for future periods.
When your Benefit Period ends, your complimentary subscription expires. You may independently choose to purchase a paid Claude subscription at the then-current price through Anthropic's standard signup process.
If you had a paid subscription paused under Section 4.1, it will resume at the end of your Benefit Period unless you cancel before billing renews. We will notify you by email at least 30 days before billing for a paused subscription resumes.
5. Publicity and Marketing Rights
By accepting a Program subscription, you grant Anthropic permission to identify you publicly as a Program recipient, including by referencing your name, GitHub username, and associated open source project(s). Anthropic may also invite you to participate in optional co-marketing activities, but your participation in any such activities is voluntary.
6. Non-Transferability and Personal Use
The Program subscription is personal to the approved Applicant and is subject to the following restrictions:
- Non-Transferable: The subscription may not be sold, resold, bartered, exchanged, traded, assigned, or otherwise transferred to any other person or entity.
- Individual Use Only: The subscription is for the individual use of the approved Applicant only.
- No Cash Value: The subscription has no cash value and may not be redeemed for cash, credit, or any other form of compensation.
- Account Sharing Prohibited: Sharing login credentials or otherwise permitting others to access the subscription is prohibited and may result in immediate termination of the subscription.
7. Fraud, Abuse, and Disqualification
Anthropic reserves the right, in its sole discretion, to disqualify any Applicant or revoke any previously granted subscription if Anthropic determines or reasonably believes that:
- The Applicant provided false, misleading, or fraudulent information in their application;
- The Applicant artificially inflated eligibility metrics (including dependents, downloads, contributions, reviews, or contributor counts) through automated means, purchased engagement, exchange schemes, bot accounts, contribution-graph padding, or other manipulative practices;
- The Applicant is using multiple accounts or identities to obtain more than one subscription;
- The Applicant has violated or is violating Anthropic’s Terms of Service or Usage Policy;
- The Applicant has engaged in any conduct that Anthropic reasonably determines is abusive, harmful, or inconsistent with the spirit of the Program; or
- The Applicant’s continued participation would expose Anthropic to legal, reputational, or operational risk.
Disqualification or revocation under this Section is without liability to Anthropic and does not entitle the Applicant to any compensation, damages, or alternative benefit.
8. Privacy and Data Use
By submitting an application, you consent to Anthropic's collection and use of the following information for the purposes of administering the Program:
- The email address associated with your GitHub account, collected in a verified manner when you sign in with GitHub (OAuth)
- Your GitHub profile data, public package-registry data (npm, PyPI, crates.io, RubyGems, Packagist, Maven), GitHub dependency-graph data, and OpenSSF criticality scores; and
- Any information you provide in your application form.
Anthropic may send you transactional emails related to your application status, subscription activation, and program participation. Anthropic will not add you to marketing email lists as a result of your application unless you separately opt in to receive such communications.
9. Modification, Suspension, and Termination
Anthropic reserves the right to modify, suspend, or terminate the Program, in whole or in part, at any time and for any reason, with or without notice. This includes the right to:
- Change the eligibility criteria;
- Reduce or increase the number of applicants eligible for subscriptions;
- Shorten or extend the application period;
- Modify the benefits provided under the Program; or
- Discontinue the Program entirely.
If Anthropic modifies these Terms in a manner that adversely affects previously approved recipients, Anthropic will make reasonable efforts to notify affected recipients via the email address on file. Failure to provide such notice will not give rise to any liability or cause of action.
Anthropic may terminate any individual subscription at any time for violation of these Terms or of Anthropic’s Terms of Service or Usage Policy.
By participating in the Program, you acknowledge and agree that you will not assert any claims or demands arising from any modification, suspension, or termination of the Program.
10. Disclaimer of Warranties and Limitation of Liability
THE PROGRAM AND CLAUDE MAX 20X SUBSCRIPTIONS PROVIDED HEREUNDER ARE OFFERED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Anthropic does not warrant that the Claude Max service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ANTHROPIC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE PROGRAM OR YOUR USE OF CLAUDE MAX UNDER THE PROGRAM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF ANTHROPIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ANTHROPIC’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE PROGRAM WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
11. Governing Law and Dispute Resolution
These Terms will be governed by, and construed and interpreted in accordance with, the laws of the State of California without giving effect to conflict of law principles. You and Anthropic agree that any disputes arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in San Francisco, California, and you and Anthropic submit to the personal and exclusive jurisdiction of those courts, to the extent permitted by the mandatory consumer protection laws of your residence.
12. Geographic Eligibility
The Program is open to eligible individuals worldwide, subject to the restrictions set forth in Section 2.3. The Program is void in any jurisdiction where prohibited or restricted by applicable law, regulation, or Anthropic policy.
13. General Provisions
- Entire Agreement. These Terms, together with Anthropic’s Consumer Terms of Service, Privacy Policy, and Usage Policy, constitute the entire agreement between you and Anthropic with respect to the Program and supersede all prior or contemporaneous understandings regarding the Program.
- Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
- No Waiver. Anthropic’s failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
- Assignment. Anthropic may assign its rights and obligations under these Terms without your consent. You may not assign your rights or obligations under these Terms.
No Third-Party Beneficiaries. These Terms do not create any rights in, or obligations to, any third party.
